Coming up January 2012:
There will be a Procedural Status Conference on the New Market complaint on January 11th 2012 at 2pm in the Frederick County Circuit Court to set a schedule for trial.
- At the plaintiffs’ request, the court had postponed any further action in this case until New Market made a final decision on pending amendments to the existing New Market Plan. It was hoped that the amendments might eliminate or reduce the issues raised in the complaint.
- New Market has now filed a motion for summary judgment. A schedule as to when that motion may be heard may also be discussed.
- New Market has now prepared a 2012 Master Plan (if you go to the link scroll down to find the plan) that has been submitted to Maryland Dept of Planning (MDP) for their review. MDP anticipates that their review of the 2012 plan will be ready by January 13, 2012 (and will be on their website here soon there). It is anticipated that New Market will adopt a 2012 Master Plan in February 2012 superseding the existing plan. New Market’s Motion for Summary Judgement does not mention the 2012 New Market Master Plan.
- Frederick County Planning Commission will review the New Market 2012 Master Plan
- To be discussed at the conference on January 11th is the effect of the likely adoption of a new master plan on the scheduling of the trial and summary judgment motion.
